Exporting Services to Kuwait From India: EDF, Invoicing and Payment Guide

Exporting services to Kuwait follows the standard Indian routine: invoice the Kuwaiti client, receive payment by international wire, and list each invoice on your monthly EDF with "Kuwait" in the Part 2B country column. The Kuwait-specific risk is timing. Contracts with retentions, approval chains or local paperwork can push payment towards the edge of your 9-month realisation window, so read the payment clauses carefully before signing and track each invoice from day one.

Key takeaways

  • Invoice in Kuwaiti dinars or US dollars, whichever the contract specifies. Many Kuwaiti businesses are used to paying international suppliers in US dollars.
  • Some contracts hold back part of each payment until completion or local formalities are done. Understand any retention before you sign.
  • The 9-month realisation period runs from the invoice date. Long retentions may need an extension request to your AD bank.
  • India and Kuwait have a DTAA. If a client raises tax deductions or asks for residency documents, involve your CA.
  • Insist on payment from the contracting company's own bank account; record any third-party payer on the EDF.

What is different about Kuwaiti clients

Indian firms working with Kuwait, especially in IT support, engineering, healthcare services and facilities-related consulting, often notice a few patterns:

  • Formal approvals. Invoices may need sign-off from several people, so the gap between invoice and payment can be longer than the stated terms.
  • Purchase orders and contract references are expected on invoices.
  • Retentions appear in some project contracts, particularly with larger organisations.
  • The working week runs Sunday to Thursday, which affects when payments are processed and when you can reach the client.

None of this is a problem if you plan for it.

KWD or USD?

Invoice in KWD Invoice in USD
Client's preference Natural for local accounts Common for international suppliers
Your exchange risk Converted to rupees at arrival Converted to rupees at arrival
EDF Part 2B currency KWD USD
Realisation period 9 months from invoice date 9 months from invoice date
Practical point Check your bank handles KWD receipts smoothly Widely handled; fewer surprises

Whichever you choose, put it in the contract and use it consistently on the invoice and EDF. Ask your bank whether it has any practical preference for receiving the currency you pick.

Invoicing a Kuwaiti client

A Kuwait-ready export invoice should carry:

  • Your legal name, address, GSTIN and export invoice number.
  • The client's registered company name and address in Kuwait.
  • PO or contract number, and a precise description of the service period or deliverable.
  • SAC code, currency and amount.
  • "Supply meant for export under LUT without payment of IGST", if exporting under LUT.
  • Bank details with SWIFT code; ask the client to quote the invoice number in the payment reference.
  • Payment terms, including who bears bank charges and any retention terms that apply.

Some government-linked clients may ask for documents to be attested or translated. If a client requests that, ask exactly what is needed and build the time into your plan. The free export invoice generator produces a clean layout you can adapt to each client.

Payments and retentions

Payments from Kuwait reach India as international wires through the SWIFT network. Your AD bank is the Indian bank where the money lands.

If your contract allows the client to retain, say, 10% of each invoice until project completion, think about the 9-month rule before you invoice. If you invoice the full amount now and the retention is released after ten months, the retained part will be unrealised past the deadline unless your AD bank grants an extension. Options include invoicing the retention separately when it falls due, or planning an extension request in advance. Discuss the right approach for your contract with your CA.

If a client proposes paying through a different company, an individual's account or a money exchange, stop and check with your bank first. Payments from a party other than your client are third-party payments, recorded in EDF fields 1.15 and 1.16. Our glossary entry on third-party payment explains the concept.

Tax: the DTAA

India and Kuwait have a Double Taxation Avoidance Agreement. Whether any Kuwaiti tax or deduction affects your fees depends on the nature of the work and how it is performed, particularly if your staff spend time in Kuwait. If a client mentions deducting tax, holding back money for tax clearance, or needing a tax residency certificate, involve your CA before agreeing terms. Our DTAA glossary entry gives the basics. We do not set out Kuwaiti tax rules here.

A worked example

Malabar Systems Pvt Ltd, a Kochi IT services company, has two Kuwaiti clients. In February 2027 it raised:

Invoice Client Description Currency Amount Retention
MS/27/021 Al Fanar Trading Co. IT support, February USD 5,400 None
MS/27/026 Gulfcrest Medical Centre Hospital system implementation, milestone 2 (90% of USD 31,500) USD 28,350 10% to be invoiced at go-live

The February EDF is due 30 March 2027 and has two Part 2B rows, both with country "Kuwait".

Gulfcrest's contract holds back 10% of each milestone until go-live, planned for December 2027, which is beyond the 9-month window for this invoice. After talking to its CA, Malabar invoiced only the 90% payable now (USD 28,350, the figure shown on MS/27/026 and in Part 2B) and will raise a separate invoice for the retention at go-live. It noted the arrangement in the remarks column.

The Gulfcrest invoice is above ₹10 lakh, so on payment Malabar will give its bank the invoice, FIRA and matching instructions. The Al Fanar invoice is under ₹10 lakh and goes into the quarterly realisation declaration once paid.

When payments drift

Kuwaiti clients usually pay, but approval chains can stretch timelines. Keep a written trail of reminders and client responses from the first missed due date. If an invoice looks likely to miss the 9-month deadline, ask your AD bank for an extension before it expires; our realisation extension request letter sets out the reasons properly.

If you also work in other Gulf markets, our guide to exporting services to the UAE covers a neighbouring set of practices. This is general information, not legal or tax advice.

Frequently asked questions

Should I invoice Kuwaiti clients in KWD or USD?

Either works if the contract says so. Many Kuwaiti businesses pay international suppliers in US dollars. Use the agreed currency on the invoice and in your EDF Part 2B row, and check your bank's handling of the currency you choose.

How do contract retentions affect my EDF?

The 9-month realisation period runs from the invoice date. If part of an invoice is retained beyond that, it remains unrealised. Consider invoicing retentions separately when they fall due, or ask your AD bank for an extension before the deadline; discuss the approach with your CA.

Can a Kuwaiti client pay from a different company's account?

Payments from a party other than your client are third-party payments. Ask your bank before accepting, get written confirmation from the client, and record the payer in EDF fields 1.15 and 1.16.

Is there a tax treaty between India and Kuwait?

Yes, India and Kuwait have a DTAA. How it applies depends on your service and whether your staff work in Kuwait. Ask your CA if a client raises tax deductions or requests residency documents.

What country do I enter on the EDF for a Kuwaiti client?

Kuwait, in the Part 2B country column for that invoice, and in field 1.17 if all the month's invoices are to Kuwait.

Bottom line

Kuwaiti work is reliable when you plan for approvals and retentions; the EDF itself is routine. Read the payment clauses, track each invoice against its 9-month date, and file monthly with our free EDF form generator.
